Privacy Notice

This Privacy Notice explains how Wuatevar Games processes personal data when you use our website, application / intake forms, and Discord community.

1) WHO IS THE DATA CONTROLLER

2) WHAT DATA WE COLLECT

We collect data in two main ways:

A) Data you provide to us

• Contact details: name (or nickname), email, Discord username (if provided)
• Role information: whether you are a player, developer, influencer, etc.
• Professional and project details you submit: studio/game details, Steam page URLs, demo/build links, video links, shared folders, screenshots, pitch decks, portfolios, social links, influencer profiles, media kits, and any similar material or content you include in your message
• Commercial/readiness details you choose to submit: launch timing, participation in events (such as Steam Next Fest), wishlist ranges/counts, publisher status, or similar project-readiness information
• Communication content: messages you send to us (email, forms, Discord DMs if you contact us) and any follow-up communications about your inquiry
• Voluntary community tasks/campaigns: information you choose to submit when you participate in optional community challenges (e.g., a video link, post, portfolio update, or other submission) and related communications.

B) Data from community participation (Discord)

If you join or interact in our Discord Server, we may process:

• your Discord username and Discord user ID
• server roles, channel access permissions
• messages and content you post in the server (as visible to server admins/moderators)
• moderation logs (warnings, bans, rule enforcement actions)

C) Technical and analytics data (only if enabled)

Depending on the Website and form setup (e.g., Vercel website hosting, Tally forms, analytics tools), we may process:

• basic log data (approximate location/country, IP address, device/browser information)
• usage data (pages visited, clicks, referrers)
• cookie identifiers

If such tools are enabled, we will request consent where required and/or offer settings.

3) WHY WE USE YOUR DATA (PURPOSES) AND LEGAL BASES

We process personal data only when we have a lawful basis under GDPR.

3.1 Responding to inquiries and collaboration evaluation

Purpose: to respond to your messages, evaluate projects and proposals, prepare high-level audits/advisory proposals, and communicate about potential collaboration.

Legal basis: legitimate interest (GDPR Art. 6(1)(f)) and/or steps prior to a contract (GDPR Art. 6(1)(b)).

3.2 Community management, safety, and moderation (Discord)

Purpose: to operate the community, prevent abuse, enforce rules, and keep the Platform safe.

Legal basis: legitimate interest (GDPR Art. 6(1)(f)).

3.3 Voluntary community tasks/campaigns (e.g., optional influencer “tasks”).

Purpose: to run optional community challenges/campaigns, to communicate with participants, to review submissions, and (where applicable) to showcase community work.

Legal basis: legitimate interest (GDPR Art. 6(1)(f)). Where a specific use would require consent (for example, certain marketing uses outside the Platform), we will ask for consent or provide an opt-out where appropriate.

3.4 Performing a Service Agreement (if you become a client/partner)

Purpose: to negotiate, sign, and perform a separate Service Agreement (e.g., Steam page advisory, onboarding / FTUE review, marketing strategy, community consulting, influencer outreach, audits, or similar advisory work).

Legal basis: contract (GDPR Art. 6(1)(b) or Art. 6(1)(c) where legally required).

3.5 Legal compliance and protecting our rights

Purpose: accounting/tax obligations, handling disputes, responding to lawful requests.

Legal basis: legal obligation (GDPR Art. 6(1)(c)) and/or legitimate interest (GDPR Art. 6(1)(f)).

3.6 Marketing communications (optional)

If we ever send you marketing emails (newsletters, promotions), we will do so only where legally allowed:

Legal basis: your consent (GDPR Art. 6(1)(a)) and/or legitimate interest where applicable for B2B contacts (depending on the message type and legal rules).

You can unsubscribe or object at any time.

4) WHO WE SHARE DATA WITH (RECIPIENTS)

We do not sell or rent your personal data.

We may share data with:

• Website hosting and form tools (Vercel for website hosting, Tally for forms)
• Authorized collaborators or contractors who assist us with community management, project evaluation, operations, or communications (on a need-to-know basis)
• Discord (as the platform hosting the community)
• Email provider(s) we use to communicate, including Mailchimp for our newsletter
• Analytics providers (only if enabled)
• Authorities or legal advisors if required by law or needed to protect our rights

Processors act under our instructions where applicable, or as independent controllers under their own terms (e.g., Discord).

5) INTERNATIONAL TRANSFERS

Some service providers (e.g., Discord, Mailchimp, and Vercel, or their sub-processors) may process data outside the EU/EEA.

Where required, we rely on appropriate safeguards (such as the European Commission’s Standard Contractual Clauses) and other measures offered by those providers.

6) DATA RETENTION (HOW LONG WE KEEP DATA)

We keep personal data only as long as necessary for the purpose:

• General inquiries and intake forms: typically up to 24 months after the last contact
• Demo links, shared folders, pitch materials, and other evaluation materials: typically up to 24 months after the last contact, unless deletion is requested earlier and is legally/technically possible
• Voluntary tasks/campaign submissions: typically up to 24 months after the last interaction, unless you ask us to delete them earlier (and deletion is legally possible).
• Moderation logs (Discord): as long as needed to enforce rules and handle disputes (typically up to 24 months, longer if needed for serious incidents)
• Service Agreement data: for the duration of the contract and then as required by tax/accounting and legal obligations
• Backups: may persist for a limited period due to technical backup cycles

7) SECURITY

We take reasonable technical and organizational measures to protect personal data (access controls, account security, limited admin access, and restricted access to submissions for authorized persons only).

However, no online service can guarantee absolute security.

8) YOUR GDPR RIGHTS

You have the right to:

• Access your personal data
• Correct inaccurate data
• Request deletion (where applicable)
• Restrict processing (where applicable)
• Object to processing based on legitimate interest
• Data portability (where applicable)

11) CHILDREN

Our Platform is intended for users aged 15+. We do not knowingly collect personal data from children under 15. If you believe a child has provided us personal data, contact us and we will delete it where required.
